ORDER
In exercise of the powers conferred under sub-section (1) of Section 3 an<i subsection
(2) of Section 5 of Minimum Wages Act, 1948 read with the notification issued
vide G.O.Ms.No.35/LAB/AIUG/2013, dated 27.09.2013 and the Order dated 19’n April,
2017 the undersigned hereby revise the rates of Dearness Allowance for the employees
employed in “Bricks & Tiles Manufactory” in the Union Tenitory of Puducherry with
effect from 01.01.2018 on the basis of rise in the average consumer price index number
reaching 299 from 286 (Base year 2001–100) and thereby resulting in an increase of 13
points calculated on the basis of average rates of Dearness Allowance w.e.f.
01 .01 .2018.
Accordingly, the Dearness Allowance payable to the classes of employees
employed in the employment of Bricks & Tiles Manufactory in the Union Territory of
Puducherry w.e.f. 01.01.2018 would be Rs. 17. 25 l- per day (cumulative).

CIRCULAR
The Government of West Bengal in the Labour Department has fixed minimum rates of wages in the
employment of Establishment as defined under the Shops & Establishments, Act, 1963 in the State of
West Bengal as per notification number Labr/650/(Law)/MW/2W-32/13 Dated 29.12.2016, as published
in the Kolkata Gazette Extraordinary dt. 30.12.2016.
(a) Now, with reference to the said notification, the following shall be the minimum rates of wages in
the said employment for the period from 1st July, 2018 to 31st December, 2018.

(b) Implementing areas: Zone ‘A’=(i) Areas under Municipal Corporations, Municipalities, notified
Areas/ Authorities, Development Authorities, Thermal Power Plants Areas including Industrial
Township Areas;
Zone ‘B’=Rest of the West Bengal.
(c ) The classification of employees in the above employment is as follows:-
Unskilled: Peon, Cleaner, Sweeper, Security Guard, Bearer, Messenger;
Semi-skilled: Duftry, Assistant Accountant,
Skilled: Clerk, Typist, Office Assistant, Office Maintenance and Inventory Management
Staff, Data Entry Operator, Accountant;
Highly Skilled: Head Assistant, Senior Accountant, Computer Operator, Research And
Development Staff/Executive, Market Research Staff/Executive, Godown-in-
Charge, Office Supervisor, Sales Representative/Sales Promotion Employees.

(d) To arrive at daily rates, monthly rates shall have to be divided by 26 and to be rounded off to the
nearest rupee and to arrive at weekly rates, daily rates shall have to be multiplied by 6.
(e ) A normal working day shall consist of eight and half hours of work including interval for halfan-
hour for rest.
(f) One day in any period of seven days as may suit the local convenience shall be the day of weekly
rest.
(g) The minimum rates of wages include the wages for weekly day of rest. Payment for work
done on the day of weekly rest and for work done beyond the normal working hours shall be
double the ordinary rate of wages.
(h) Where the existing rates of wages of any employee based on contract or agreement or otherwise are
higher than the rates notified herein, the higher rates shall be protected and treated as minimum
rates of wages applicable for the purpose of this notification to such employees.
(i) The minimum rates of wages are applicable to employees employed by contractors also.
(j) The minimum rates of wages for disabled persons shall be same as payable to the workers of
appropriate category.
(k) The men and women employees shall get the same rates of wages for same work or work of similar
nature.
(l) The minimum rates of wages and Variable Dearness Allowance, if any, both together shall
constitute the minimum rates of wages to be enforceable under the Minimum Wages Act, 1948 (11
of 1948).

Updates – The Minimum Wages (Delhi) Amendment Bill, 2017

Summary

 The Minimum Wages (Delhi) Amendment Bill, 2017

 

  • Insertion of the interpretation of the State Government which means the Lieutenant Government of National Capital Territory of Delhi, appointed by the President under  Article 239 and designed under Article 239AA of the Constitution.

 

  • The Central Government or the State Government in relation to any scheduled employment shall take into account the following in fixing or revising the minimum rates of the wages.
  1. The skill required
  2. The arduousness of the work assigned to the worker
  3. The cost of living of the worker and
  4. Such other components which are related to fixing or revising minimum rates of wages

 

  • Minimum wages payable under this Act shall be paid by depositing  the same in the bank account of the employees, electronically or by account payee check in place of in cash.

 

  • In special circumstances like fire in the establishment, natural calamities, death of employer or director of the establishment, the payment of wages may be made in cash.

 

  • The Employer shall pay the employee for every hour or for part of an hour so worked in excess at the overtime rate fixed under this Act.
  • Shall not be less than two times of the normal rate of wages fixed under this Act

 

  • The workman shall not be retrenched, dismissed, terminated or laid-off during the pendency of the proceeding or inquiry without the prior approval of the Authority before whom the application is pending.

 

  • Under the penalties for certain offences, every employer shall be punishable with
  1. Imprisonment for a term of three years or
  2. With fine of fifty thousand rupees or
  3. With both

 

  • Under the General provision for punishment of other offences, every employer who contravenes any provision of this Act or of any rule or order made thereunder shall be punishable with
  1. imprisonment for a term of one year or
  2. with fine twenty thousand rupees or
  3. with both

 

  • The Court before whom the complaint is made, shall dispose of the same within a period of three (3) months from the date of making of the complaint.

 

  • The employer shall upload the employee data on website or web portal.

Payment of wages (Uttar Pradesh Amendment ) Act,2017

Payment of wages Act,1936 is amended in its application to Uttar Pradesh after receiving assent of the president on January 10,2018 and published in the UP Gazette dated 29th January,2018 with the name of Payment of Wages (Uttar Pradesh Amendment Act, 2017) which states-

 

The Payment of wages Act, 1936 is a Central Government Act but states can frame their rules under it. UP Government has modified the rules to affect the payment of wages only by cheque or bank transfer.

 

“Each employer of industrial or any other establishment shall pay wages to his employees through Bank cheque or National Electronic Fund Transfer or Electronic clearing Service System into the Bank account.

 

The cash payment of the earned wages requested by the employee can be done to them not exceeding Five thousand during a period of three months, provided the employee requests in writing and provide a self-attested Aadhar card.

 

A sub section 20-A is inserted for composition of offences above the fine or with imprisonment upto six months or with both committed under this Act for a sum of fifty per cent of the maximum fine provided for such offence.  Get the latest updates, subscribe this blog and stay update.
